Abstract

|
In our country, though imported tissue substances for transplantation have a great deal of shortcomings in terms of cost and safety, rate of dependence on imports is much higher due to lack of donation. And, such problems have been raised continually on ethical aspect in the process of tissue procurement, commercialization of transplantation substances and safety of transplantation. However, there aren’t enough public institutions and systems to support, direct and supervise donationㆍtransplantation of the tissue in order to activate present tissue donation, ensure morals and transparency of the transplantation process, improve safety and quality of transplantation substances.
First, this study intended to inspect the present issues on the legal system of tissue donation ㆍtransplantation. Second, it examined WHO Guiding Principles on Human Cell, Tissue and Organ Transplantation with tissue management systems of American network type and British centralized control type. Finally, based on the critical analysis on domestic and foreign situations, it derived improvements on the legal system of tissue donationㆍtransplantation management.
